Petitioner, apprehends his arrest registered for the offences punishable under Sections 399, 402, 414, 279, 427 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.
Informant who is a police officer has alleged that he received a confidential information that 10-12 criminals have assembled with arms and ammunitions in order to commit some grave crime in Swift and Figo car and on

No.56994 of 2019(3) dt.11-12-2019 2/3 receiving said information as he reached the place of occurrence along with other police persons then Figo car dashed against railing and five criminals started fleeing away however two were apprehended on chase and three managed to escape who disclosed their names as Aditya Kumar and Mukund Kumar and from the possession of both the apprehended persons one loaded country made pistol with live cartridges were recovered who disclosed the name of other accused who manged to escape including the name of petitioner. The car was driven by the petitioner and Adhar Card and Bank Passbook of petitioner was recovered from car.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner has no criminal antecedent.
In the facts and circumstances, I am not inclined to grant privilege of pre-arrest bail to him and accordingly his such prayer stands rejected.
However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being
