The petitioner seeks bail in Nardiganj P.S. Case No. 236 of 2020, registered for the offence under Sections 341, 323, 379, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., this petitioner alongwith other coaccused persons stopped the informant and thereafter, started assaulting him. It is further alleged that while co-accused Janardan Yadav started searching pocket of informant, it was objected by him, as a result of which, co-accused Janardan Yadav fired from his pistol, which hit the informant on the finger of his left hand.

It is submitted on behalf of petitioner that as per F.I.R. itself, co-accused Janardan Yadav caused fire-arm injury and so far as this petitioner is concerned, there is general and omnibus

Patna High Court CR. MISC. No.69769 of 2021(2) dt.07-03-2022 2/2 allegation of assault. Petitioner has got clean antecedent and he is in custody since 19.09.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Nawada in connection with Nardiganj P.S.
