JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have opened fire causing firearm injuries on the left side of abdomen and both hands of his brother/informant. The alleged occurrence is said to have taken place on account of family feud and land dispute. Submission on behalf of the petitioner is that there was land dispute between the parties and as a matter of fact, it was prosecution party, who assaulted the wife of the petitioner for which wife of the petitioner lodged Salkhua P.S.Case No. 209 of 2015. It is further submitted that the informant of the present case, sustained simple injuries which are said to be caused by the petitioner by firearm and for the aforesaid offence, petitioner is in

Patna High Court Cr.Misc. No.3099 of 2016 (2) dt.01-02-2016 2/2 jail custody since 8.12.2015 and the investigation against the petitioner has already been completed.

Accordingly. let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Saharsa in connection with Salkhua P.S.case No. 208 of 2015.
