The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 353 of 2015 for the offences punishable under Sections 147, 341, 323, 307, 504, 506, 379 and 302 of the Indian Penal Code.
Ms. Bela Singh, learned counsel for the petitioner with reference to the allegations made in the FIR submits that although there are specific allegation against the accused Munna Sahni and Mahesh Sahni of assaulting the mother and brother of the informant respectively and there is also allegation against Naresh Sahni and Banke Sahni of insisting others to commit loot but the only allegation made against this petitioner is of relieving the informant of Rs. 18,000/-. It is, however, submitted that after
Patna High Court Cr.Misc. No.53002 of 2015 (2) dt.17-12-2015 undergoing treatment the mother of the informant died but there is no allegation against the petitioner of assaulting her. He submits that the allegation of theft is only an improvement on the dispute. Having heard learned counsel for the parties and considering the nature of allegation set out in the FIR, let the petitioner, namely, Raju Kumar in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, West Muzaffarpur and/or the court concerned in connection with Kanti P.S. Case No. 353 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
