Counsel for the petitioner submits that his suspension having been revoked in terms of the office order dated 22.8.2008 issued by the Chief Engineer, Water Resources Department, Gaya, he would be entitled to payment of arrears of salary and other consequential benefits arising therefrom for the period June 2006 to December 2007, i.e. the period during which he was under suspension. His representation for the said benefit dated 5.7.2011 submitted before the Superintending Engineer, Waterways Circle, Ghoshi, Jehanabad is pending.

Patna High Court CWJC No.1538 of 2016(2) dt.10-01-2019 2/2 In view of the aforesaid facts the final decision/payment arising out of the office order dated 22.8.2008 has to be taken by the Superintending Engineer (Respondent No. 4).

In view of the said submission, this writ petition is disposed of with a direction to respondent No. 4 to pay admissible dues of the petitioner on account of office order dated 22.8.2008 expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order in accordance with law.

The writ petition stands disposed of.
