This is an application for grant of anticipatory bail in connection with Siswan P.S. Case No. 143 of 2017 registered for the offence punishable under Sections 447, 448, 341, 323, 354, 379, 504/34 of the Indian Penal Code.
The allegation against the petitioner and other accused persons is assaulting the informant and her daughter resulting in injury to them.
The learned counsel for the petitioner submits that the petitioner is the Army man who had come to his village on leave and was trying to prevent the scuffle taking place in between the informant side and other co-accused persons. It is further submitted that the petitioner has a clean antecedent. The injuries
Patna High Court Cr.Misc. No.60412 of 2017 (3) dt.30-01-2018 2/2 sustained by the prosecution side are simple in nature. The learned counsel for the petitioner further submits that the present case arises out of case and counter case.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siswan P.S. Case No. 143 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
