20-05-2015 On call, a prayer is being made on behalf of the petitioner, in presence of learned AC to AAG-2 as well as Sri Ramesh Kumar Chaudhary, learned counsel for private Respondent, for adjourning the case.

The present writ petition pertains to a dispute under the provisions of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, which is a scheduled Act under Section-9 of the Bihar Land Tribunal Act, 2009. The Tribunal constituted under the Bihar Land Tribunal Act, 2009 is already functioning.

The Court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

Accordingly, in terms of proviso to Section 15 of the Bihar Land Tribunal Act, the Registry is directed to transmit the record of the case to the Bihar Land Tribunal
