The petitioners apprehend their arrest for the offences punishable under sections 307 and other allied sections of the Indian Penal Code.
The informant named the petitioners along with other accused persons and alleged that on the order of Narendra Singh, Tinku Singh, petitioner no.1, assaulted the informant by iron rod on his head and Sonu Singh @ Sonu Kumar, petitioner no.2 assaulted on his hand .
It is submitted that the informant is co-sharer of the petitioners and on account of some petty dispute occurrence took place. The injury found on the head of the informant is simple in
Patna High Court Cr.Misc. No.52195 of 2015 (3) dt.22-12-2015 2/2 nature, but the injury found on the hand of the informant is grievous in nature.
Considering the fact that simple injury is caused on account of assault made by Tinku Singh, petitioner no.1, he, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Gopalganj in Bhorey P.S. Case No. 74 of 2015, subject to the conditions as laid down in section 438 (2) of the Code of Criminal Procedure, 1973.
So far petitioner no.2 Sonu Singh @ Sonu Kumar is concerned, he assaulted the informant by hockey on his hand causing fracture injury which is found to be grievous in nature, I am not inclined to enlarge him on anticipatory bail and accordingly the same is rejected.
