2. The petitioner seeks regular bail in a case registered under Sections 30(a) and 32(3) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, 1118 liters of English wine and Beer was recovered from the truck bearing Registration No. BR25A-0418 and the petitioner is stated that he was the driver of the said truck.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not the owner of the truck and he had no knowledge about the seized liquor. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is
Patna High Court CR. MISC. No.57292 of 2025(3) dt.10-09-2025 2/2 in jail custody since01.07.2025. He has clean antecedents. Charge-sheet has already been submitted after completion of investigation. He further submits that there is no likelihood of absconding the petitioner or tampering with the evidence and he undertakes to cooperate in trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Siwan, in connection with Siwan P.S. Case No. 437/2025.
