The petitioner is father-in-law of the deceased who was married to his eldest son 15 years ago. He is facing accusation punishable under Section 302, 201/34 of the IPC lodged by the father of the deceased.
Allegation is that the victim was tortured as she was dark in complexion. The husband with the help of family members solemnized second marriage. The husband used to threaten her and torture her. On the relevant date the informant was informed about the unnatural death of the victim in the matrimonial home. Contention of the petitioner is that on going through the FIR, it appears that it was the husband who used to torture. There is no direct evidence against the petitioner. Some other
Patna High Court Cr.Misc. No.52226 of 2015 (2) dt.18-12-2015 2/2 accuseds of this case have either been released on anticipatory bail or regular bail by this Court. Petitioner is aged person and languishing in jail custody since 05.06.2015. Considering the facts and circumstances of the case, this Court is inclined to extend the privilege of bail to the petitioner. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. case no. 95 of 2015, corresponding to G.R. No. 1844 of 2015, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.
(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
