====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-02-2023 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 380, 504, 427, 448, 452, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with other co-accused persons came at the informant's house and started assaulting him and his family members. It is further alleged that they also fired upon informant's side but not hit anyone.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant and petitioner are of same locality and a dispute

Patna High Court CR. MISC. No.59842 of 2022(2) dt.07-02-2023 2/2 regarding land is gong on between them due to which the petitioner has falsely been made accused in this present case. It is further submitted that several persons including petitioner were having pistol in their hand but none of the informant's family has sustained any injury of fire arm. There is no allegation of any overt act against the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 2.3.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Gadhpura P.S. Case No. 4 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Begusarai.
