This is an application for grant of anticipatory bail in connection with Nawada Town PS case no. 379 of 2011 registered for the offences punishable under Section 395 of Indian Penal Code.
The allegation in this case is regarding commission of robbery by unknown accused persons.
The learned counsel for the petitioner submits that the name of the petitioner has transpired in paragraph no. 46 of the case diary in the supervision note of the police which has got no relevance in the eyes of law. It is further submitted that no recovery has been made from the possession of the petitioner or
Patna High Court Cr.Misc. No.62633 of 2017 (3) dt.12-01-2018 2/2 from his house. It is also contended that the petitioner has a fair antecedent barring one case, in which, he has already been granted anticipatory bail.
Having regard to the facts and circumstances of the case, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Nawada Town PS case no. 379 of 2011 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
