JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

As per the prosecution case, three miscreants riding on a motor cycle assaulted the informant and snatched his cash and mobile.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner and save and except confessional statement of co-accused there is no material on record to against this petitioner to show his

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateI, Hilsa, Nalanda in connection with Parwalpur PS case No. 46/2021, subject to conditions laid down u/s 438(2) of the Cr.P.C.
