Petitioner seeks regular bail in connection with Benipatti P.S. Case No.67 of 2021 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 326, 307, 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
According to the FIR, this petitioner and other accused persons, namely, Prashant Jha, Vishwajit Kumar, Sujay Safi and Ankit Jha badly injured informant's son Manoj Singh by assaulting him with pistol, iron rod and pipe. Learned counsel for the petitioner submits that as per the injury report contained in the case diary, injured Manoj Singh was treated at a private hospital and no specific injury
Patna High Court CR. MISC. No.69541 of 2021(3) dt.25-04-2022 2/2 report is on the record. However, the doctor found only one injury on the body of the injured. Several similarly situated coaccused have already been allowed bail vide paragraph 11 of the supplementary affidavit. Investigation is complete. Petitioner claims clean antecedent and he is in custody since 20.4.2021. Considering the period of custody of the petitioner, his clean antecedent and the fact that investigation is complete, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Addl Chief Judicial Magistrate I, Madhubani in Benipatti Police Station Case No. 67 of 2021.
