The petitioner, namely, Md. Shanu @ Umar Faruque @ Shanu @ Md. Shanu is in custody in connection with S.T. No.176 of 2015 arising out of Rautara P.S. Case No.46 of 2014 under Section 395 of the Indian Penal Code.

The learned counsel for the petitioner submitted that in similarly situated case, the co-accused Uttam Singh @ Amit Kumar Singh has already been granted bail by this Court in Cr. Misc. No.27601 of 2015. The co-accused confessed before the Court and he named Uttam Singh and others including this petitioner and, therefore, the case of this petitioner is on same footing. Considering the fact that the co-accused has already been granted bail, who was in custody since 24.12.2014 and the petitioner is also in custody from that day, I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IV, Katihar in connection with S.T. No.176 of 2015 arising out of Rautara P.S. Case No.46 of 2014.
