The petitioner apprehends his arrest in Complaint Case No.464C of 2016 registered under Sections 420, 467, 468, 120B, 34 of the Indian Penal Code.
1/3 The complainant alleged that the petitioner sold 4 decimals of land of Khesra No.862/1181 of Khata No.140 to the complainant on 19.01.1996 and the complainant planted trees but Buchan Yadav came and cut the trees. On inquiry, it transpired that Yoganand Yadav(petitioner) played fraud and he never purchased any piece of land from Mahanthi Yadav. Mahanthi Yadav also disclosed that he never executed any sale deed in favour of Yoganand Yadav.
Patna High Court CR. MISC. No.57995 of 2019(2) dt.19-09-2019 2/2 Mr. Arun, the learned counsel for the petitioner submits that the petitioner executed sale deed in the year 1996 but the complaint petition was filed after twenty years from the date of execution of the sale deed but it transpired that the petitioner had no title over the land sold by him. The petitioner cheated the complainant and executed the sale deed after taking heavy amount from the complainant.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
