The petitioner apprehends his arrest in Jamui P.S. Case No. 233 of 2015 registered for the offences punishable under Sections 147, 148, 341, 323, 307 and 379 of the Indian Penal Code and under Sections 3(i)(x) SC/ST Act.
The petitioner along with other accused persons is named in the FIR. There is no specific allegation against the petitioner that he abused the informant by naming his caste. No offence under Sections 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act 1989 is made out. Similarly situated co-accused Munna Singh has already been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide orders passed in Cr. Misc. No. 58559 of 2015 on 22.01.2016.
Patna High Court Cr.Misc. No.9061 of 2016 (4) dt.21-06-2016 2/2 Shri Ambika Bhagat the learned Spl. PP did not dispute the facts.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in Jamui P.S. Case No. 233 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
