JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Shambhuganj P.S. Case No. 118 of 2018 registered for the offences punishable under Sections 341, 323, 498(A), 494, 504/34 of the Indian Penal Code. Petitioner happens to be the second wife of the husband of the informant as per FIR.

Submission of the learned counsel for the petitioner is that there is no allegation of assault or demand of dowry against this petitioner and she also denied her marriage with husband of the informant.

Heard learned A.P.P. also.

In view of the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court CR. MISC. No.57337 of 2019(2) dt.11-09-2019 2/2 before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Shambhuganj P.S. Case No. 118 of 2018 subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
