====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 09-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in connection with Sangrampur P.S. Case No.180 of 2020 instituted under Sections 341, 323, 324, 325, 307, 354, 379, 504/34 of the Indian Penal Code and Sections 30(a), 32 & 41(1) of Bihar Prohibition and Excise Act.
3. As per the prosecution case, the petitioner alongwith other co-accused persons assaulted the informant. It is specifically alleged that co-accused Raj Kumar Mahto assaulted with Dabiya and co-accused Tahalu Mahto assaulted with rod on the informant causing injury to her. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case by the informant with ulterior motive on account of previous enmity arising out of land dispute. He further submits that there is general and omnibus allegation against the petitioner and there is no specific overt act levelled against the petitioner. Learned counsel submits that petitioner has no concern with the seized illicit liquor. He further submits that similarly situated co-accused, namely, Tahalu Mahto @ Shiva Lal Mahto @ Shiva Balak Mahto has been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 24.05.2021 passed in Cr. Misc. No.1848 of 2021. Learned counsel submits that petitioner is a lady, having no criminal antecedent and she undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the concerned Court
Patna High Court CR. MISC. No.57490 of 2025(2) dt.09-09-2025 3/3 within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court No.1, East Champaran, Motihari in connection with Sangrampur P.S. Case No.180 of 2020, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
