JUSTICE RAKESH KUMAR ORAL ORDER 14-12-2015 Heard Dr. Alok Kumar, learned counsel, who was assisted by Sri Hans Lal Kumar, learned counsel for the petitioner and Sri Nand Kishore Prasad, learned A.P.P. The petitioner, who is in custody in connection with Minapur P.S. Case No. 79 of 2014 registered for the offence punishable under Section 147, 148, 149, 341, 323, 504, 379 of the Indian Penal Code and Section 17 of the C.L.A. Act, has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner has been made accused only on the basis of confessional statement of the co-accused. Save and except confession, there is no other material.

Learned A.P.P. has opposed the prayer for bail. He

Patna High Court Cr.Misc. No.52830 of 2015 (3) dt.14-12-2015 2/2 submits that petitioner is having antecedent and he is accused in almost similar cases.

Keeping in view the nature of accusation and the fact that petitioner is in custody only since 8.9.2015, I am not inclined to extend the privilege of bail.

The petition stands dismissed.
