The petitioner is apprehending his arrest in connection with Excise Complaint Case No.4/19 registered for offences punishable under Sections 30(a) of the Bihar Prohibition Excise Act, 2016.

Allegation against the petitioner is about recovery of 25 lrs. of liquor from the co-accused Ganauri Singh and he has disclosed that the motorcycle belongs to the petitioner. Submission of the learned counsel for the petitioner is that he was not present there and he has been falsely implicated in this case.

Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the recovery is from the motorcycle and the

Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day..

With the aforesaid direction, this application is disposed of.
