The petitioner seeks bail in a case registered for the offences under Sections 302/34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 31.08.2021, charge-sheet has been submitted and has antecedent of three cases and the informant alleges that he received information that his father has been killed by three unknown motorcycle borne criminals accordingly, the informant reached the hospital and saw the dead body of his father, thus alleges that unknown criminals killed his father under conspiracy as people were jealous of his progress. The learned counsel for the petitioner submits that FIR was against unknown and the name of this petitioner transpired in the confessional statement of co-accused, Dhanraj Kumar, in police

Patna High Court CR. MISC. No.69876 of 2021(2) dt.26-04-2022 2/2 custody which has no evidentiary value and later the petitioner was arrested and he was made to confess his participation in the present occurrence. It is further submitted that co-accused Jitendera Kumar @ Munna has been granted bail by order dated 24.03.2022 passed in Cr. Misc. No. 62459 of 2021.

The learned A.P.P. vehemently opposes the bail application.

Considering the fact that petitioner is in custody since 31.08.2021, charge-sheet has been submitted and his name transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Fatuhan P.S. Case No. 110 of 2021, with a condition that one of the bailor shall be the father of the petitioner (Dinesh Choudhary).

The application stands allowed.
