JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is allegation of firing against the petitioner but petitioner is in jail custody since 22.08.2013 and earlier when petitioner moved for bail before this court, a co-ordinate Bench of this court rejected the prayer giving liberty to petitioner to renew his prayer for bail after completion of two years in jail custody. The impugned order shows that up till now, only charge could be framed and not a single prosecution witness has been examined as yet.

Considering the observation given by a co-ordinate Bench of this court as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing
