The petitioner apprehends his arrest in connection with Sheikhpura P.S. Case No.202 of 2019, registered for the offence punishable under Section 420 of the Indian Penal Code. Allegation against the petitioner is that he is the member of a syndicate involved in withdrawing money illegally from the bank account of the customers.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that no specific overt act is alleged against the petitioner and the petitioner is ready to return the said amount, i.e., Rs.20,000/- to the informant.

Patna High Court CR. MISC. No.57501 of 2022(2) dt.02-01-2023 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that the petitioner is the member of a syndicate involved in cyber crime. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
