JUSTICE SANDEEP KUMAR ORAL ORDER 30-07-2024 This application has been filed for quashing of the part order dated 28.07.2023 passed in Complaint Case No. 173 of 2019 by the A.C.J.M., Bikramganj, Rohtas by which the court below has imposed a condition to deposit 20 % of the amount of the dishonored cheque to the petitioner.

2. The contention of the petitioner is that the entire amount has been paid to the O.P. No.02 and the cheque has wrongly been presented by the O.P. No. 02.

3. These questions of fact cannot be considered in quashing application.

4. Accordingly, this application is dismissed with liberty to the petitioner to raise all the grounds in the court
