2. The petitioner seeks bail in connection with Nawkothi P.S. Case No.138 of 2022 registered for the offence punishable under Sections 420/379 of the Indian Penal Code and section 66, 66(c) and 66 (D) of I.T. Act.

3. As per the prosecution case, the petitioner is alleged to have been involved in cyber fraud.

4. The petitioner has handed over a demand draft of Rs. 78,000/- which is the part of the cheated amount to the learned counsel for the informant without accepting his guilt and without prejudice to his case. The petitioner has remained in jail for more than four months.

5. In view of the period of custody as well as the fact that the petitioner has paid a part of the cheated amount, this application is allowed.

6. Since the petitioner is already on provisional bail, he is not required to surrender in the Court below. Accordingly, the provisional bail granted to the petitioner is hereby confirmed. He will furnish fresh bail bonds in the Court below.

7. The petitioner will also mark attendance in Barbigha Police Station, Sheikhpura on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
