====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 14-07-2016 Heard the learned counsel for the petitioner. This writ application under Article 227 of the Constitution of India has been filed against the order dated 5.2.2016 passed by Principal Judge, Family Court, Samastipur in Divorce Case No.122 of 2015 whereby the plaint has been returned to the petitioner for proper presentation before appropriate forum on the ground of territorial jurisdiction.

This order returning the plaint is appealable under the Code of Civil Procedure. Therefore, if so advised, the petitioner may avail the said remedy under the Code itself. This writ application under Article 227 of the Constitution of India is thus not maintainable and accordingly, it is dismissed. Sanjeev/- (Mungeshwar Sahoo, J) U T
