Petitioner seeks modification of the order dated 28.04.2016, passed in Cr. Misc. No. 17583 of 2016 by which the petitioner was granted pre-arrest bail on the event of his arrest or surrender before the learned court below within a period of eight weeks from the date of the order.

It has been submitted by the learned counsel for the petitioner that he could not surrender before the learned court below within the time prescribed, as he suffered fracture in his right knee and was undergoing treatment from 20.04.2016 and now when he has recovered he seeks modification of the order and prays for extension of time of surrender before the court below. Considering the facts and circumstances and the statement made in paragraphs 3 and 4 of the modification

Patna High Court Cr.Misc. No.52373 of 2017 (2) dt.08-11-2017 2/2 application, period of surrender is extended for a further period of four weeks from today.

Order dated 28.04.2016, passed in Cr. Misc. No. 17583 of 2016 is modified to the extent indicated above in connection with Hajipur Sadar P.S. Case No. 286/14, pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur. Modification application is, accordingly, allowed. (Nilu Agrawal, J) Rajesh/- U T
