Petitioner is named in the first information report and it is alleged that petitioner and other F.I.R. named accused took the deceased from his house and subsequently, dead body of the deceased was recovered.

Learned counsel for the petitioner points out that having more or less similar allegation, some co-accused have already been granted privilege of bail. Moreover, the impugned order shows that none of the prosecution witnesses claimed to have seen the actual killing of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
