JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Barun P.S. Case No. 178 of 2019, registered for the offences punishable under Sections 379, 411, 420/34 of the Indian Penal Code and Section 4 and 40 of the Bihar Minor and Mineral Concession Rule and Section 15 of the Environment Protection Act.

Allegation against the petitioner is that he happens to be the driver of the tractor carrying the sand in the tractor without having proper license.

Submission of the learned counsel for the petitioner is that petitioner is only driver of the tractor. Furthermore, there was no sand loaded on the tractor rather earth soil loaded on it. He has no criminal antecedent and he is ready to abide by condition imposed on him.

In view of the above facts and circumstances, let petitioner, above named in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No.178 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
