The petitioner seeks anticipatory bail in Amour P.S. Case No.69 of 2017 instituted for the offences under Sections 147, 148, 149, 341, 342, 323,307, 353, 427, 332/333 and 504 of the Indian Penal Code.

Allegation has been made that some unsocial elements started creating nuisance . On receipt of the information police party reached to the hospital and found that they were creating nuisance. When the police party tried to pacify the matter they, leaving the hospital employees, started quarrelling with the police party. They have forcibly kept the informant in hostage and they tried to snatch the revolver but he could be saved.

Patna High Court Cr.Misc. No.53296 of 2017 (2) dt.06-12-2017 When higher officials reached then the situation was pacified. Learned counsel for the petitioner submits that there is omnibus allegation and there is no specific allegation against the petitioner.

Looking to the entire facts into consideration, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on the same day on its own merit without being prejudiced by the present order.
