The petitioner apprehends her arrest in connection with Kadwa P.S. Case No. 214 of 2017, registered under Sections 376, 342 and 323/34 of the Indian Penal Code and Section 4 of the POCSO Act, pending in the court of the Chief Judicial Magistrate, Katihar.
The accusation is that when informant was returning to her house from college in the meantime, she was called by the petitioner in her house and breakfast was served. Thereafter, she loss her consciousness and petitioner locked her in the room in which one Sintu Kumar Mehta was present who forcibly committed rape upon the informant. Later on, informant was kept in the mustered field from where she was taken by her parents.

No.51477 of 2017 (2) dt.01-11-2017 2/2 Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
