JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323 and 427 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that on 06.03.2015 at 5 PM the petitioners came to the house of the informant armed with deadly weapons and damaged the roof sheet of the informant. It is also alleged that the petitioners resorted to fire in the air to create terror. The petitioners were pressurizing to withdraw the case filed by the informant at earlier point of time.
It is submitted by learned counsel for the petitioners that no injury was caused to anyone. The petitioners are co-villagers of
Patna High Court Cr.Misc. No.6522 of 2016 (2) dt.11-02-2016 2/2 the informant and petitioners' side submitted a written report against the informant on 07.03.2015 resulting into Sanha Diary entry no. 186 of 2015 but ultimately it was registered as a police case being Kinjar P.S. Case No. 24 of 2015 on 16.03.2015 whereas the present case was registered on 09.03.2015 for the occurrence of 06.03.2015. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the case lodged by the petitioners' side at earlier point of time and delayed lodging of the present FIR, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Arwal in connection with Kinjar P.S. Case No. 20 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
