The petitioners apprehend their arrest in I.F. Case No. 135 of 2022 arising out of Crime Report No. 17P dated 10.07.2022, registered for the offences punishable under Sections 33, 41, 42 of the Indian Forest Act and section 2, 17, 27, 29, 31, 51(i) of the Wild Life Protection Act. As per the prosecution case, these petitioners were found leveling the land for cultivation by tractor in the forest area of Valmiki Tiger Reserve.

As a matter of fact, the land of petitioner no. 3 is adjacent to the boundary of Valmiki Tiger Reserve and the petitioners used to cultivate the land for their livelihood for the last forty years. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist Class, Bagaha, West Champaran in connection with I.F. Case No. 135 of 2022 arising out of Crime Report No. 17P dated 10.07.2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
