2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
3. As per the prosecution case, the informant lodged a case against 3 unidentified accused persons for stealing the Scorpio vehicle and Rs. 8000 cash of the informant.
4. It is submitted that petitioner is not named in the F.I.R. The name of the petitioner has transpired during investigation on the confessional statement of co-accused Subash Poddar. Petitioner is neither user of mobile no. 7319972195 nor the registered owner of the said mobile. The looted vehicle was recovered from the possession of co-accused Tanvir. Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/concerned court below in connection with Jokihat P. S. Case No. 73 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Shishir/- U T
