JUSTICE JYOTI SARAN ORAL ORDER 16-12-2015 Heard Mr. Devendra Prasad Singh, learned counsel for the petitioner and learned counsel for the State. The petitioner apprehends his arrest in connection with G.O. Case No. 22 of 2015 for the offences punishable under Section 47A of the Excise Act.

Mr. Singh, learned counsel for the petitioner with reference to the complaint present at Annexure-1 submits that although the name of the petitioner appears in the accused column and the recovery is mentioned in the recovery column but there is absolutely no explanation or accusation as to the connection in between the petitioner and the alleged recovery. He further submits that even the recovery is not within the precincts of the petitioner.

Having heard learned counsel for the parties and

Patna High Court Cr.Misc. No.52983 of 2015 (2) dt.16-12-2015 considering the materials reflecting from the record, let the petitioner Ram Jatan Yadav in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class-Nawada and/or the court concerned in connection with G.O. Case No. 22 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Jyoti Saran, J) S.Sb/- U T
