JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State assisted by the O.P. no.2. The petitioner apprehends his arrest in connection with Sultanganj P.S.Case No.110/16 registered under Sections 498A, 341, 323/34 of the I.P.C. and Section 3⁄4 of D.P.Act. Learned counsel appearing on behalf of the petitioner submits that on the joint prayer of the learned counsel for the petitioner and the O.P.No.2 the matter was referred to the Patna High Court Mediation Centre, Patna to settle the dispute between the parties but mediation could not succeeded. On the other hand, learned counsel for O.P.No.2 submits that while
Patna High Court Cr.Misc. No.9530 of 2017 (4) dt.06-10-2017 2/2 O.P.no.2 appeared before the mediation centre but neither petitioner nor his lawyer appeared. As such, mediation failed. Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
