ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 04.07.2019 in connection with Mahua P.S. Case No. 438 of 2018 registered for the offence under Sections 414/34 of the Indian Penal Code and Sections 30/30 (A),38,42 of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were made from a van and the petitioners were only found standing near the van and they have nothing to do with the recoveries. It is further submitted that petitioners have no criminal antecedents.

No.57841 of 2019(2) dt.13-09-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioners have clean antecedents, let the petitioners, above named, be released on bail on their furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II cum - Excise Court, Vaishali at Hajipur, in connection with Mahua P.S. Case No.438 of 2018.
