The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act.

The prosecution case is that the petitioner was travelling on a motorcycle when pillion rider Shahid Ali was apprehended and petitioner escaped from the scene. From the apprehended accused one country made pistol and mobile were recovered.

It is submitted by learned counsel for the petitioner that the name of the petitioner surface in the statement

Patna High Court Cr.Misc. No.55453 of 2015 (2) dt.07-12-2015 2/2 of co-accused and there is no recovery from the petitioner. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Bettiah Town P.S. Case No. 562 of 2015 pending in the court of learned Chief Judicial Magistrate, Bettiah, West Champaran.

With the aforesaid observation, this application is disposed of.
