JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-04-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Imamganj Police Station Case No. 134 of 2015, disclosing offence under Section 304B, 201/34 of the Indian Penal Code.
Considering the fact that the petitioner is the husband of the deceased and the deceased died within 7 (seven) years of marriage, I am not inclined to grant the petitioner privilege of anticipatory bail.
This application is accordingly rejected.
The petitioner, Ajeet Mishra @ Ajeet Kumar Mishra, is directed to surrender before the Court below
Patna High Court Cr.Misc. No.7678 of 2016 (3) dt.22-04-2016 2/2 within a period of four weeks from today and seeks regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
