JUSTICE ARVIND SRIVASTAVA ORAL ORDER 12-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Chautham P.S. Case No. 91 of 2017 registered for the offence punishable under sections 420, 406, 409, 120B, 467, 468 and 471/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to village politics. The present first information report has been lodged after delay of about one year without any explanation. Petitioner has no concern with the co-accused of this case. During investigation also nothing has come against this petitioner. Similarly situated co-accused persons have been granted bail by this Court vide order dated 24.08.2017 and 17.10.2017 passed in Cr. Misc. Nos. 31865 of 2017 and 47003 of 2017. Petitioner has

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, II, Khagaria in connection with Chautham P.S. Case No. 91 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
