2. The petitioner has preferred this application for grant of regular bail in connection with Manjhauliya P.S. Case No. 484 of 2024 dated 29.07.2024 registered for the offences punishable under Sections 103(1), 238 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the informant alleges that a decapitated dead body of an unknown woman was found lying in a plastic bag near canal and later, it came to light that it was the dead body of the daughter of the co-accused, Virendra Sah.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.59591 of 2025(2) dt.15-11-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has surfaced in the confessional statement of the co-accused persons, Virendra Sah and Prabhu Sah. There is no specific allegation against the petitioner rather the specific allegation is against the co-accused, Golu Kumar, Vicky Sah and Virendra Sah. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.06.2025. The co-accused, Virendra Sah has already been granted regular bail by the Co-ordinate Bench of this Court vide order dated 09.04.2025 passed in Cr. Misc. No. 86005 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bettiah, West Champaran in connection with Manjhauliya P.S. Case No. 484 of 2024, with a condition:- (i) The petitioner is directed to remain physically

Patna High Court CR. MISC. No.59591 of 2025(2) dt.15-11-2025 3/3 present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
