The petitioner seeks bail in connection with Kharagpur P.S. Case No. 159 of 2012 registered under Sections 302 and 201 read with Section 34 of the Indian Penal Code. It has been contended that though the petitioner is named in the FIR the informant has made allegation against altogether five persons including the petitioner on the basis of suspicion. The further contention is that identically situated coaccused Govind Yadav has already been granted bail by a coordinate bench of this Court vide order dated 19.12.2014 passed in Criminal Miscellaneous No. 30981 of 2014 as
Patna High Court Cr.Misc. No.52872 of 2015 (2) dt.01-02-2016 2 / 2 contained in Annexure-2 to the present application. It has also been contended that co-accused Ganga Yadav and Pawan Yadav who are also named like the petitioner in the FIR have also been granted bail by coordinate benches of this Court vide orders dated 11.06.2014 and 26.02.2015 passed in Criminal Miscellaneous Nos. 22745 of 2014 and 6693 of 2015 respectively.
Learned counsel for the State has opposed the application filed on behalf of the petitioner. He has submitted that the informant has suspected the hands of the petitioner and others in the killing of her son.
Be that as it may, regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 159 of 2012.
