The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406, 323, 504 and 506/34 of the Indian Penal Code. The prosecution case is that co-accused Saral Mahto and Hari Mahto executed a registered agreement to sell of three katha land in favour of the informant for consideration of ruppes three lakhs. It is alleged against the petitioner that the petitioner used to threaten the informant. It is submitted by learned counsel for the petitioner that thrust of accusation is against Saral Mahto and

Patna High Court Cr.Misc. No.53307 of 2015 (2) dt.23-11-2015 2/2 Hari Mahto whereas on conclusion of investigation the petitioner was not sent up for trial but differing with the final form cognizance has been taken and considering the nature of accusation Saral Mahto and Hari Mahto have been granted anticipatory bail vide Cr. Misc. No. 50506 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -cum- Sub-Judge-VI, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 142 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
