The petitioner being PACS Chairman is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
It is alleged that the petitioner being PACS Chairman took money from the farmers for payment of cost of paddy procured at the behest of the govt.
It is submitted by learned counsel for the petitioner that the petitioner is ready to make payment of the cost of the paddy procured.
Considering the aforesaid facts, let the
Patna High Court Cr.Misc. No.53312 of 2015 (2) dt.23-11-2015 2/2 above named petitioner be released on anticipatory bail provisionally for two months in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhagalpur in connection with Kajraili P.S. Case No. 46 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The provisional bail of the petitioner will be confirmed by the learned court below if the claimed amount of the farmers will be refunded by the petitioner. (Dinesh Kumar Singh, J) DKS/- U T
