The petitioners are apprehending their arrest in a case registered for the offences punishable under sections 323, 448, 341, 325, 504/34 of the Indian Penal Code and 3(1)(x) of SC/ST P.O.A. Act.
Prosecution case is that the accused persons entered into the house of the informant and demanded money received by the informant under Indira Awas and on protest being made the informant was assaulted and abused by calling his cast name.
Learned counsel for the petitioners submitted
Patna High Court Cr.Misc. No.53782 of 2015 (2) dt.26-11-2015 2/2 that for the occurrence of 02.03.2015 F.I.R. was registered on 13.03.2015 and there is no explanation for the delay. The delayed lodging of the case constitutes grant for consideration of prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with SC/ST Hajipur P.S. Case No. 9/15 pending in the court of learned Additional Chief Judicial magistrate, Vaishali at Hajipur.
With the aforesaid observation, this application is disposed of.
