Mr. Awadhesh Kumar Mishra, learned counsel appearing on behalf of the petitioner placed reliance on Annexure-9, the guidelines issued by the Director, Secondary Education dated 30th June, 2015 to contend that the petitioner is entitled to be considered for grant of appointment on the post of Librarian in terms of Annexure -9 in respect of Danapur Nagar Parishad.

Considering the submission advanced by Mr. Mishra that he

Patna High Court CWJC No.2238 of 2016 dt.13-03-2018 2/2 has a right to consideration in terms of Annexure-9 which was issued by the Director, Secondary Education.

The writ petition is disposed of with the direction to the respondent-Director, Secondary Education to see that if right accrued to the petitioner in terms of Annexure-9, his interest may be safeguarded by the Director by issuing appropriate order in this regard. The Court without entering into the validity of the claim of the petitioner, permit the petitioner to approach the Director for redressal of his grievance in the light of Annexure-9. The Director is expected to address the issue raised by the petitioner in the representation proposed to be filed on behalf of the petitioner along with the copy of this order within a maximum period of 60 days from the date of receipt of the representation.

It is made clear that this Court has not expressed any opinion on the merit of the case. It is for the Director to examine the claim of the petitioner and pass appropriate order.
