The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 342, 427, 504, 379, 447, 448, 354, 307 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the accused persons came
Patna High Court Cr.Misc. No.54512 of 2015 (2) dt.02-12-2015 2/3 variously armed when on the order of co-accused Raja Yadav, coaccused Ram Ishvar Yadav resorted to fire causing injury on the leg of one Ajay Yadav and, thereafter, co-accused persons assaulted the informant's side mercilessly. The accused persons also assaulted the sister of the informant and snatched gold ornaments and cash of Rs.50,000/-.
It is submitted by learned counsel for the petitioners that from the informant's side three persons have been received injuries, which is found simple in nature whereas specific accusation of firing is against co-accused Ram Ishvar Yadav. The accusation of assault is not specific against these petitioners. There is counter versions of the occurrence also wherein three persons from the petitioners' side have received injuries. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Jehanabad in connection with
