The petitioner is in custody since 29.06.2019 in connection with Vaishali P.S. Case No.234 of 2019 registered for the offence under Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been named in the F.I.R. on the basis of the confessional statement made before the police by one Munna Kumar on whose statement recovery of alleged motorcycle has been made from the house of one Ravi Ranjan Kumar but not from the conscious possession of the petitioner.
