====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER --------- 13-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Laheri P.S. Case No.256 of 2017 registered under Sections 271, 272, 278, 290, 295(A), 153(A), 429, 420 and 120(B) of the Indian Penal Code besides Section 11(2) of the Animal Cruelty Act. The accusation is that on receiving secret information about loading of the packets of beef on the truck bearing Registration No.BR06GB-2630 at Chandni Kalali, Kona Sarai, the informant being the Officer Incharge of Laheri Police Station alongwith other police officials reached there and saw some persons engaged in loading the packets of the beef on the truck.

No.54018 of 2017 (2) dt.13-11-2017 2/2 On seeing them, the persons engaged in loading the packets of the beef started to flee away but three persons were apprehended, who disclosed their name as Md. Jahid, Md. Arif and Raju (the driver of the truck). They also disclosed the name of Tallu, Mona, Afroz and the name of the owner of the truck as Md. Maruf (petitioner). Learned counsel for the petitioner submits that while the petitioner is the owner of the truck on which the beef was being loaded but the petitioner had no knowledge that the driver of the truck had gone for the purpose of transporting the beef on the truck. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Nalanda at Biharsharif, in connection with Laheri P.S. Case No.256 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
